Thermos® “What Matters to Me” Video Contest

At Thermos, what matters to us is providing the best possible portable food and beverage containers for people on the go while using the best quality materials. But we want to know how Thermos® products play a part in what matters to you. Maybe you live for weekend hikes with your Thermos hydration bottle in tow? Or you can’t bear a morning commute without a Thermos brand bottle full of steamy coffee? Or you love cheering on your little soccer players with FUNtainer™ bottles waiting for them on the sidelines.

So we want to know: what really matters to you? We can’t wait to hear what you have to say.

The contest:

  • Submit your self-created video (2 minutes or under) briefly sharing with us what matters to you.
  • Post your video either on your blog (let us know about it on Twitter @ThermosBrand) or through our YouTube Group (http://www.youtube.com/group/ThermosBrandGroup).
  • Our favorite videos will be featured on our (soon-to-be revealed) brand new Thermos Web site.

The prize:

Besides being featured on the new Thermos Web site, we want to help you get together with the people that matter to you most this holiday season. To say thank you for sharing your thoughts on what matters to you, we will provide five grand prize winners with a $500 travel voucher and five first place winners with a Thermos insulated product gift pack. Winners will be announced in mid December.

Video entries accepted from 12:01 a.m. CST on Monday, November 30, 2009 until 11:59 p.m. on Friday, December 11, 2009.

Winner will be notified on or around Monday, December 14, 2009 by email, YouTube message or Twitter message.

  • WHO CAN ENTER: Entrants submitting/posting their video for this contest must be 18 years of age or older (“Entrant or You”). Limited to legal residents of the U.S. only (excluding Puerto Rico). Potential winners, as condition of receiving any prize, will also be required to sign and return an Affidavit of Eligibility, Acceptance of Prize Form, a Liability Release and a Publicity Waiver within seven (7) days of notification of winning.

  • HOW TO ENTEROn Personal Blogs or YouTube

Personal blogs: Bloggers may post their “What Matters to Me” videos on their personal blogs. Thermos must be notified of the public posting through the Twitter platform. The @ThermosBrand account can be notified by @reply or direct message. To qualify, the video entry must be posted on entrants personal blog and the notifying “tweet” must be posted before 11:59 p.m. on Friday, December 11, 2009 and stay live through December 31, 2009. Deleted posts will result in disqualification.

YouTube: Entrants must join the Thermos “What Matters to Me” YouTube group at www.youtube.com/group/ThermosBrand, and upload their “What Matters to Me” video for public viewing. The group administrator will approve all videos that follow the theme and are appropriate for public viewing. The group administrator reserves all rights of refusal and may choose to not post videos that are deemed inappropriate or offensive. To qualify through YouTube, entry videos must be uploaded before 11:59 p.m. on Friday, December 11, 2009 and stay live through December 31, 2009. Deleted comments or blog posts will result in disqualification.

Limit one entry per person per video created. All eligible entry videos must be uploaded between 12:01 a.m. CST on Monday, November 23, 2009 until 11:59 p.m. on Friday, December 11, 2009.

All submissions must be the original work of the person submitting the video,  never been previously published, or submitted in any competition, must not infringe on any third party rights, and may not include content which is offensive, violent or suggests violence, derogatory, sexually suggestive, obscene, defamatory, contains explicit language or imagery or is otherwise inappropriate for publication in general circulation, or depicts Thermos and/or any of its products in a manner which is not consistent with its positive image and/or its approved trademark use.  No other manufacturers’ products are permitted in the video submission, nor may entries contain false or disparaging information about Thermos or its competitor. Entries may not contain any personal identification such as personal names, email addresses, or street addresses of anyone else.  Entrant warrants and represents that Entrant has received written permission to submit the video to Thermos from each individual appearing in Entrant’s video, or permission from parent(s) or guardian(s) if an individual is a minor.  Upon request Entrant must submit such proof to Thermos.

Entries cannot depict Thermos’ products being used in any other way than for their intended purpose and cannot depict unsafe or illegal behavior.  By submitting the video, the entrant gives Thermos the right to use, edit, or publish the submission without any further compensation to Entrant. Entry of a video further constitutes the Entrant consents to irrevocably assign and transfer to Thermos in perpetuity any and all rights, title and interest in the video, including without limitation, all copyrights and rights of publicity including the right to publicly display, perform, reproduce and distribute the video and/or excerpts on the Internet, in presentations, marketing materials and any other media Thermos chooses and for any and all media now know or hereinafter devised. If required, Entrant will sign any documents necessary to transfer copyright and rights of publicity to Thermos or another party which Thermos designates. If an Entrant’s video is chosen to be posted on the Website, Entrant may have to certify in writing that his/her entry was original and produced by Entrant and no other person or entity holds rights to the video.

Thermos reserves the right to disqualify entries and take down content that does not conform to these Official Rules.

All video submission materials become the property of Thermos and will not be returned.  Thermos is not responsible for any change of email address of Entrants. Do not mail anything to Thermos. It will not be opened, will not be returned to the Entrant and will be destroyed.

In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the account holder of the Twitter or YouTube account, as applicable, at time of entry. A valid email address must be provided for the YouTube account.

Thermos L.L.C. assumes no responsibility for lost, late, misdirected, illegible or mutilated entries.

  • JUDGING: All qualifying entry videos will be considered equally and will be judged by a panel selected by Thermos. Judging will be based as follows: twenty percent on the creativity of the content and eighty percent on the content’s connection to the “What Matters to Me” theme. The judging will occur on or around Wednesday, December 9 for the grand prize winners. The winners will be notified by email, YouTube message or Twitter message on or around December 14, 2009.  Decisions of judges are final. The odds of winning depend on the number of entries received.
  • PRIZES: There will be five (5) grand prize winners. Grand prize includes one $500.00 travel voucher from an airline carrier or gasoline company. Grand prize winners will have the choice of airline gift card (from the following carriers: American Airlines, JetBlue, Southwest, Continental, Delta, Air Tran, United, US Airways) or a gas gift card (from the following options: ExxonMobile, Shell, BP, Amoco, Chevron, Philips 66, Gulf Oil, Marathon, Sinclair, Speedy, Texaco, 76, Arco, Circle K, Sunoco). There will be five (5) first prize winners. Second prize winners will receive a package of Thermos® insulated products with an estimated retail value of $75. Winners are responsible for all federal, state and local taxes applicable to the acceptance and use of his/her prize. Thermos will issue a 1099 tax form to the winner for the approximate retail value of the prize.

Thermos shall not be liable for any claim arising from winner’s use or dissatisfaction with any prize.

5.         GENERAL RULES: Employees ofThermos L.L.C., its affiliates, subsidiaries, advertising/promotion agencies and the immediate family members (defined as spouse, domestic partner, parents, siblings, or children) and those living in same household of each are not eligible.  Void where prohibited by law.  All federal/state/local laws and regulations apply. By participating in this Contest, Entrants agree to be bound by these Official Rules and decisions of judges, which are final in all respects.  Winners will be notified by email, YouTube message or Twitter message on or around December 14, 2009. Winners may make no substitution/transfer of prize.  All federal/state/local taxes are sole responsibility of the winner. Winners will be required to execute and return an Affidavit of Eligibility and Liability Waiver and (where not prohibited) Publicity Release within seven (7) days of attempted notification or potential winner will be disqualified. The winner must commit to the prize by Friday, December 18, 2009. Non-compliance with the terms of these Official Rules in any way may result in disqualification; an alternate may be selected. Thermos reserves right to substitute prize of equal/greater value at its sole discretion.  By acceptance of prize, the winners grants permission to Thermos to use and license winners’ name/likeness/biographical information/entry material and any other information provided by entrant for any lawful purpose, including for purposes of advertising and trade, in any manner and in all media (whether now known or hereafter devised) throughout the world at any time without further permission, notice or compensation, unless prohibited by law. By entering, Entrants release and hold harmless Thermos L.L.C, its respective parents, subsidiaries, affiliates, directors, officers, employees, attorneys, agents and representatives from and against any and all liability whatsoever for any injuries, loss, claim, action, demand of damage of any kind arising from or in connection with the contest, participation in the contest, acceptance, possession, use, misuse or malfunction of any prize won, participation in any contest related activity, any liability for any economic injury, personal injury, property damage, loss or other harm  and any claims based on publicity rights defamation or invasion of privacy, copyright infringement, trademark infringement, or infringement of any third party right. Recipient of prizes assumes all liability for any injury/damage caused/claimed to be caused by participation in this contest or use/redemption of any prize. 8.         Miscellaneous: Thermos is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prizes. Thermos assumes no responsibility or liability for any errors or problems of any kind, whether mechanical, human, electronic or otherwise, which may limit a user’s ability to participate in the contest, including, but not limited to: (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this contest; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the contest; or, (d) inaccessibility or unavailability of the internet or the Web site or any combination thereof; (e) any injury or damage to participants or to any other person’s computer which may be related to or resulting from any attempt to participate in the contest or download any materials in the contest.

Thermos reserves the right to (1) disqualify any Entrant and void any entries of an entrant who has engaged in inappropriate conduct, fraud or other misconduct relative to this contest or otherwise attempted to tamper with or impair the contest, and to (2) cancel, modify, suspend or terminate the online portion of the contest if, in Thermos’ sole opinion, technical failures, applicable laws or regulations, virus, bugs, unauthorized human intervention or other cause beyond Thermos’ control destroys the integrity of the contest or otherwise corrupts or impairs the administration, security, legality, fairness or proper play of the contest or any part thereof.

Thermos also reserves the right at its sole discretion to disqualify any Entrant found to be tampering with the entry process or the operation of the contest or the website, or to be acting in any manner Thermos deems to be in violation of the Official Rules or disruptive, or with intent to annoy, abuse, threaten or harass any other person. If, for any reason, the contest is not capable of running as planned for reasons which may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, violation of applicable law or regulation or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this contest, Thermos reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest in whole or in part.

CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
